Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the website and services at mytoran.com, operated by Toran Inc., a Delaware corporation with its principal place of business in Washington, USA (“Toran”, “we”, “our”). By creating an account or otherwise using any part of Toran, you agree to these Terms.

If you do not agree, do not use Toran.

1. Beta Status

Toran is currently in private beta. Access is invite-only via an allowlist; if you are not on the allowlist when you sign up, your email is added to a waitlist. Features, availability, and behaviour may change without notice during beta. Pricing and paid plans are not active during beta and are not part of these Terms.

2. Your Account

You must be at least 16 years old to create a Toran account. You are responsible for keeping your account credentials confidential and for all activity under your account. Notify us immediately at support@mytoran.com if you suspect unauthorised access.

You may not create an account on behalf of another person without their consent, or use automated means to create accounts in bulk.

To close your account, email support@mytoran.com with the subject line “Account Closure”. A self-service account closure flow is on our roadmap.

3. Acceptable Use

You agree not to:

• Upload images containing child sexual abuse material (CSAM), illegal content, or content that violates the privacy or other rights of third parties. You must have the right to upload any photograph you upload.
• Upload identifiable images of other people without their consent — for example, faces of household members, neighbours, or clients in their own homes.
• Attempt to reverse-engineer, scrape, or extract Toran's underlying models, prompts, or proprietary configurations.
• Use Toran to generate content that infringes the intellectual-property rights of others.
• Circumvent, disable, or otherwise interfere with security features of Toran, or with the rate limits and usage limits we apply.
• Resell, sublicense, or commercialise access to Toran without our prior written consent.
• Use Toran for any purpose that violates applicable law.

We reserve the right to suspend or terminate accounts that violate these rules, with or without prior notice. Suspected CSAM will be reported to the appropriate authorities as required by law.

4. Intellectual Property

Your uploaded images

You retain full ownership of the photographs and other images you upload to Toran. By uploading an image, you grant Toran a limited, non-exclusive, worldwide licence to process, transmit to the AI inference providers listed in our Privacy Policy, and store that image solely to provide the services you have requested. We do not claim any ownership over your originals.

AI-generated outputs

When Toran produces a generated, edited, or modified image in response to your instruction, we do not claim ownership of that output beyond what we receive from the underlying inference provider. Subject to that provider's terms (including OpenAI's assignment-to-customer terms for generated images, and the equivalent terms of Replicate and FAL.ai), you may use the output for personal and commercial purposes — for example, in portfolios, on social media, in client presentations, or in any other context that respects third-party rights.

AI copyright disclaimer: The legal status of AI-generated images under copyright law is evolving and varies across jurisdictions. Toran makes no warranty that AI-generated outputs are free from third-party intellectual-property claims. We recommend consulting a legal professional before using AI-generated content in regulated commercial contexts.

Where outputs would reasonably be mistaken for original photographs or human-authored work, you are responsible for disclosing their AI-generated nature when sharing them externally.

Toran's intellectual property

All other content on mytoran.com — including the Toran name, logo, software, design, text, and visual assets — is the exclusive property of Toran Inc. and may not be reproduced without our written permission.

5. Design Disclaimer — “As-Is” Clause

Toran is a design exploration and visualisation tool. It is not a substitute for professional architectural, structural, contractor, or certified interior-design services.

Generated room visualisations are artistic interpretations. They do not account for:

• Accurate room dimensions, load-bearing walls, or structural constraints.
• Building codes, fire-safety regulations, or accessibility requirements.
• Exact product specifications, colours, materials, or availability.
• Spatial flow, ergonomics, or professional layout recommendations.

Before making any real-world purchase, renovation, or structural modification, you must independently verify dimensions, product specifications, and suitability with qualified professionals. Toran assumes no liability for decisions made based on generated outputs.

6. Service Availability

Toran is provided on an “as-is” and “as-available” basis. We do not guarantee that the service will be uninterrupted, error-free, or available at any particular time. We may impose daily usage limits on AI features, and we may modify, suspend, or discontinue any feature at any time, particularly during private beta.

7. Termination

Either party may terminate this agreement at any time. You may close your account by emailing support@mytoran.com. We may suspend or terminate your account for violation of these Terms or any activity we reasonably believe poses a legal or security risk.

On termination, your right to access Toran ceases immediately. Data deletion follows the timeline described in our Privacy Policy.

8. Disclaimers and Limitation of Liability

To the fullest extent permitted by applicable law, Toran is provided without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Toran Inc. and its affiliates, officers, employees, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, arising from your use of or inability to use Toran — even if we have been advised of the possibility of such damages.

Our total liability for any claim arising from these Terms is limited to the greater of (a) the total amount you have paid Toran in the three months preceding the claim, or (b) USD 100.

Nothing in these Terms limits liability for fraud, gross negligence, or anything else that cannot lawfully be limited.

9. Indemnification

You agree to indemnify and hold harmless Toran Inc. and its affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of (a) your breach of these Terms, (b) your violation of any third party's rights, or (c) content you upload to Toran.

10. Copyright Complaints (DMCA)

If you believe content available through Toran infringes your copyright, please send a written notice to support@mytoran.com with the subject line “DMCA Notice”. Your notice should include: a description of the work you claim has been infringed; the location (URL or path) of the allegedly infringing material on Toran; your contact information; a statement under penalty of perjury that the information is accurate and that you are the rights holder or authorised to act on the rights holder's behalf; and your physical or electronic signature. Toran will register a designated DMCA agent with the U.S. Copyright Office before exiting private beta.

11. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law provisions. The exclusive venue for any dispute that cannot be resolved by binding arbitration is the state or federal courts located in Washington, United States, and you and Toran consent to personal jurisdiction in those courts.

Disputes shall first be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, on an individual basis. You and Toran each waive any right to a jury trial and any right to bring claims as part of a class action. Either party may seek injunctive or other equitable relief in a court of competent jurisdiction.

EU and UK users: nothing in these Terms affects your statutory rights under applicable consumer-protection or data-protection law.

12. Changes to These Terms

We may update these Terms as Toran grows. For material changes, we will notify you by email at least 14 days in advance. If you continue using Toran after the effective date, you accept the revised Terms.
